Privacy Policy

This Privacy Policy sets forth the information gathering, use, and dissemination practices of ScoreHero, its affiliate and subsidiary companies ("ScoreHero") in connection with its Web site located at www.ScoreHero.com (the "Site"). This Privacy Statement addresses ScoreHero's practices regarding information collected only directly through or from the Site

It does not address or govern any information collected from the visitor (sometimes referred to as "you" or "your") from any source other than directly through or from the Site (such as telephone, facsimile, postal mail, personal delivery, or other or additional offline means or media). This Privacy Statement is incorporated into ScoreHero's Statement of Use, which must be reviewed and accepted by you.

The policy is intended to provide you with information about how we collect, use, disclose, and otherwise process your personal data, the choices you have related to our processing of your personal data, and how you may exercise your access and other rights over your personal data.

By providing your information to us through the Services, or otherwise using any of our Services, you understand, acknowledge and accept that ScoreHero may process your information, including personal data, in accordance with this Privacy Policy.

1. Children

Please be aware that the Site is a general audience web site, not directed to children under the age of 13, and must not be used by children under 13. ScoreHero and the Site take important measures to comply with the Children's Online Privacy Protection Act (COPPA). If you are the parent of a child under the age of 13 who you believe is accessing the Site or contributing personal information wittingly or unwittingly to ScoreHero or the Site, contact ScoreHero immediately as set forth in Section 10, so that we may restrict access and destroy such information.

2. Collection of Personal Information - What and Why

2.1 Basic Account Information (Required to create your account)

When registering for a new Account, ScoreHero will require your email address, as well as a username and password of your choice. This information is necessary to create a ScoreHero account and provide you with services hosted on the Site.

Your account will be automatically assigned a unique number ("user ID") that is used to later reference your user account, in conjunction with the username.

Your password is never stored in plaintext within the database, and is unknown to Site operators.

Your email address is stored with encryption for the purposes of:

  1. verifying your email address exists using a unique confirmation URL sent to your email;
  2. limiting non-human / bots from successfully registering accounts; and
  3. necessary future communications from ScoreHero.

Your email address is not publicly disclosed with other users of the site, or shared with any third parties.

Your date of birth is also requested and processed upon account account registration to verify that you are over the age of 13 years old.

Upon successful registration, your birth date is anonymously tallied to help us understand the age groups of our userbase and potentially aid in marketing efforts (see Section 3 for Advertising) - it is not stored with any connection to your account information.

2.2 Your Information (Other Data you voluntarily provide)

ScoreHero collects the described information in this section ("Your Information") which you choose to provide in association with the following community services provided on the Site.

2.2.1. Scores

Submissions of your scoring results for playthroughs of levels and/or songs in supported video games, which may include external URL links to photo and/or video proof of such score(s) and an optional textual comment description may be provided to the Site.

This information is processed to generate score-tracking features such as leaderboards, user rankings, and scoring summary reports across the Site.

The Site provides functionality for you to edit and delete any submitted score information.

Should you choose to terminate your account prior to deleting your scores, ScoreHero may anonymize your scores information and keep them in our database and leaderboards to maintain added value to the community. Score anonymization will include deleting all external URL links to photos and videos from your scores, as well as any submitted comments, and changing your displayed username to "anonymous."

2.2.2. Forums

A forum account is automatically created upon account registration with the same user name, email, and password as originally provided.

Your forum profile allows "Additional Profile Information" to be provided, such as:

  • Avatar Image URL
  • Signature (i.e. text and/or embedded image(s) which appears in your forum posts)
  • XBL Gamertag
  • PSN Name
  • Wii Friend Code
  • ICQ Number
  • MSN Messenger Name
  • Personal Website URL
  • Location
  • Occupation
  • Interests

All of this information is entirely optional, and anything that you choose to provide will be shared publicly with other visitors of the Site (including unregistered guest visitors).

You have full control to update and/or remove any of this information at any time.

In addition, you may create new threads for community discussion, or post replies to contribute to existing threads of discussion; and you may send and receive private messages to and from other users of the Site.

Threads, posts, and messages which you submit to the forums, as well as Additional Profile Information is content that you may access and control at any time, including ability to edit and delete.

Sent private messages which have already been received and read by the intended recipient cannot be deleted from the recipients inbox (and thus the ScoreHero database) by the sending user. Such content deletion can only be processed either by the user issuing a full account termination (see Section 8.3), or by ScoreHero operators processing a specific request for erasure (see Section 10).

If you are the original poster for thread(s) consisting of a collaborative community effort (such as an informative guide, or statistical compilation, which involved input from other members), ScoreHero may transfer ownership to another user to resume maintenance of the thread(s) prior to processing an account termination request.

2.2.3. Wiki

A wiki account is automatically created upon account registration with the same user name, email, and password as originally provided.

You may choose to activate your "User Page" on the ScoreHero wiki to share further profile information with other site visitors. See the "User Pages" section here for information to create and edit and/or remove content from your User Wiki Page.

In addition, you may contribute new pages to the wiki and/or edit the content on certain other public wiki pages.

See a list of pages you've created and pages you've edited.

It may not be possible to entirely remove your specific edit history and contribution to wiki pages which are the result of a collaboration of users. However, any association to account information will be permanently anonymized in the event of account termination, with your publicly displayed username changed to "anonymous."

If you are the original owner for wiki page(s) consisting of a collaborative community effort (such as a guide, or statistical compilation, which involved input from other members), ScoreHero may transfer ownership to another user to resume maintenance of the page(s) prior to processing an account termination request.

2.2.4 Custom Songs

Submissions of user-generated files with customized game content may be posted to the Site to be shared with other registered members on the Site. This includes, for each custom song submission, information describing the song or audio referenced, the configuration options that are available for play, a URL linking to the file containing the user-generated content (hosted externally), a URL linking to a preview video, and a textual comment description. The Site provides custom song author controls to manage such content, including edits and deletions. Upon an account termination request, all custom song entries by the requesting user will be removed from our database.

2.2.5 Special Promotions

On occassion, ScoreHero might offer special promotions or contests with sponsored prizes to be awarded to winning entrants. Any additional information required to sign up for entry will be accompanied with a request for your consent to collect and process the information along with explanation for why it is necessary and how it will be processed. This information will only be retained for the necessary length of time to fulfill our obligations in regard to the specific promotion for which the information was collected (e.g. to contact winnners and ship out prizes).

2.3 Information We Collect Automatically

2.3.1 Tracking Information and Cookies

ScoreHero uses cookies, which are text files placed on your computer, to help track your browsing session across web pages on our Site with separate settings for each device which can be used to remember your username and provide automatic login if requested to "Remember Me" upon logging in with cookies accepted by your browser.

Although most web browsers automatically accept cookies, the decision of whether to accept or not is yours. You may adjust your browser settings to prevent the reception of cookies, or to provide notification whenever a cookie is sent to you.

You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that if you do this, you may not be able to access the full functionality of our websites.

2.3.2 Usage Information

ScoreHero collects information related to how you use the Site, including some actions you take (such as the date of your most recent login, your most recently viewed page on the Site, and timestamps for certain actions requested such as content deletions, downloads of custom song files, and any resulting errors that are flagged).

We use this information to improve services, help troubleshoot problems, develop new services and features, and protect users. This information is for use by Site operators and is not disclosed publicly or with any third parties.

2.3.3 Device Information

ScoreHero collects information from and about the client devices that you use to access the Site Services. This includes your global IP address, the type of browser and device being used, and the web page visited before coming to our Site. This information is stored upon certain behaviors such as your first page visit within a session, and logging in or out to/from your account

This information is processed by Site operators to investigate security issues when necessary, and to impose restrictions against a user (i.e. block access to our services) for violations of our Terms of Service, for the purpose of limiting repeat offenders to ensure integrity of our leaderboards and to maintain a positive experience for the ScoreHero community. This information is for use by Site operators only, and is not disclosed publicly or with any third parties.

2.3.4 Information Required to Detect Violations

We may collect certain data that aids in our detection, investigation and prevention of intentional false Score submissions, and other violations of the Terms of Use and applicable laws ("Violations"), such as internal documentation of our findings from investigating a user incident, and flags raised from automated procedures designed to detect Violations. This data is used only for the purposes of detection, investigation, prevention and, where applicable, acting on such Violations. If the data indicates that a Violation has occurred, we will further store the data for the establishment, exercise or defense of legal claims during the applicable statute of limitations or until a legal case related to it has been resolved. Please note that the specific data stored for this purpose may not be disclosed to you if the disclosure will compromise the mechanism through which we detect, investigate and prevent such Violations.

2.4 Information that we obtain from third party service providers

2.4.1 Google Analytics

We use "Google Analytics" to collect information about use of this Site, such as how often users visit the Site, what pages they visit when they do so, and what other site they used prior to coming to this Site. Google Analytics collects only the IP address assigned to you on the date you visit this Site, rather than your name or other identifying information. Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this Site. This cookie cannot be used by anyone but Google, Inc. The information generated by the cookie will be transmitted to and stored by Google on servers in the United States.

We use the information received from Google Analytics only to improve services on this Site. We do not combine the information collected through the use of Google Analytics with personally identifiable information. On behalf of the website operator, Google Analytics uses the data to compile reports on website activity, and to provide other services relating to website activity and internet usage made available for website operators. Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Privacy Policy. You can prevent Google Analytics from recognizing you (including collection of your IP address) on return visits to this Site by disabling the Google Analytics cookie on your browser (https://tools.google.com/dlpage/gaoptout/).

2.4.2 PayPal

ScoreHero accepts voluntary donations and uses PayPal to control and process all payment information for transactions. Upon clicking the button to Donate to ScoreHero, we transmit the user's User ID to PayPal, and collect and store the following information in return:

  • User ID
  • Status (i.e. whether the payment transaction was successful)
  • Donation Amount
  • Timestamp
  • PayPal Transaction ID

This information allows us to process and award various benefits for donating to ScoreHero at different tier levels. The PayPal Transaction ID is kept for reference to resolve disputes or discrepancies, as well as for financial accounting purposes. While the Site operator has access to view the PayPal transactions through PayPal, no personal data involving donation transactions are stored on ScoreHero's servers. 2.4.3 CafePress

ScoreHero uses CafePress to offer users merchansise products such as T-shirts, hats, mugs, etc. While the Site operator has access to view purchase transactions through CafePress, no data (personal or otherwise), related to merchandise purchase transactions are stored on ScoreHero's servers. 2.4.4 UserVoice

ScoreHero uses the services of UserVoice to gather and respond to feedback and requests for desired features from the community (http://scorehero.uservoice.com). All information provided to UserVoice by our users is controlled and processed by UserVoice. 2.5 Communication with ScoreHero

Any email sent to a scorehero.com domain address is also information that we retain in our email archives. This typically includes user requests, appeals, or questions and ScoreHero responses. The correspondence is kept for our recordkeeping to maintain a record of which emails have been answered, and how prior issues were handled. Unless compelled by a law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary ScoreHero does not share email corresponce or any representations of such data with any third parties.

2.6 User Reports

The Site provides a feature for users to click an icon associated with either a user's scores, a specific score, or a specific forum post, in order to quickly alert Site Operators toward potential concerns that need to be addressed. We treat your information collected in these reports in the same manner as email correspondence outlined in Section 2.5, and similarly retain an archive of user reports and our responses for recordkeeping purposes. Upon an account termination request, the contents of any associated user reports will be retained by ScoreHero, but the user's username will be anonymized.

2.7 No special categories of information

We do not request or intend to collect any "special categories of information" such as any information on health, race, religion, political opinions or philosophical beliefs, sexual preferences or orientation. Kindly be cautious when sharing this information about yourself (or others) in our forums, wiki, comment fields throughout the Site, or in email correspondence to ScoreHero representatives.

3. Advertising

ScoreHero currently does not serve any third party advertisements.

We are equipped to provide such advertisements, and if our business practice changes to utlize them, any advertising partners that we use will be listed in this section along with links to their Privacy Policies, and proper notice will be sent to allow you to review, understand and consent to the change. Our general policy with regard to advertisement is outlined below.

We may use third-party advertising companies to serve ads when you visit our Web site. These companies may use aggregated anonymized information from us (not including your name, address, email address or telephone number), such as the percentages of our users within certain age groups, and reports on website activity generated from Google Analytics, in addition to information about your visits to this and other Web sites, such as your IP address, in order to provide advertisements about goods and services of interest to you. IP address is typically used by advertisers to broadly determine the general geographic area you are coming from - for example country, state, and sometimes at city level.

4. Sharing of Personal Information - With Who

4.1 Public Guests

Any person visiting the Site has access to view your submitted scores, forum posts, wiki pages and/or edits for pages marked as public, and "Additional Profile Information" voluntarily provided as outlined in Section 2.2; all as associated with your public username.

4.2 Other Users

Other registered members additionally have access to view information associated with your Custom Song submissions as outlined in Section 2.2.4.

4.3 Site Operators

ScoreHero moderators and administrators additionally have access to view your email address, and view and process Usage and Device information as outlined in Sections 2.3.2, 2.3.3, and 2.3.4 related to troubleshooting user issues, responding to user requests or appeals, and taking actions against violators of our Terms of Use.

4.5 Law Enforcement

We may share your personal information to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person.

4.6 Buyer

Identifiable or non-identifiable visitor information and data which visitors provide to ScoreHero may be disclosed or distributed to another party with which ScoreHero enters or reasonably may enter into a corporate transaction, such as, for example, a merger, consolidation, acquisition, or asset purchase.

5. Data Security

ScoreHero has implemented numerous security features that are designed to prevent the unauthorized disclosure of, or access to, personal information. For example, ScoreHero undertakes efforts to maintain a secure server with updated software; restrict administrative access using encryption keys and host whitelisting; run software with limited permissions; deploy a web application firewall; encrypt storage of personally identifiable information (such as email addresses); store passwords using strong adaptive hash algorithm; validate user inputs; not store any user credit card information; require certain team members and service providers who work for or with ScoreHero to sign confidentiality agreements restricting their use of any data related to user information.

Despite these efforts, the confidentiality of communication or material transmitted to or from ScoreHero via this Site or email cannot be and is not guaranteed. You acknowledge that the technical processing and transmission of the Site content may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices. ScoreHero is not responsible for the security of information transmitted via the Internet.

6. Data Retention

When you sign up for an account with us, we’ll retain the information you store on our services hosted on the Site for as long as your account is in existence or as long as we need it to fulfil the purposes for which the information is collected and processed. Or, if longer, for the storage and retention period as required by law.

If you request to delete your account, we will initiate the deletion and anopnymization of your information as specifically outlined in Section 8.3 without undue delay for the primary instance of your data on our live production system. Please note: (a) there might be some latency in deleting this information from our back-up storage (see Section 7); and (b) we may retain information if necessary to comply with our legal obligations, to resolve disputes, or enforce our agreements.

7. Backup Archive Retention

ScoreHero creates automatic database backup archives, typically on a weekly basis, which contain the same personal data as described in this policy, and may contain your personal data for a period of time after you have requested to delete your account.

These backups are necessary because, due to the nature of our database, it is impractical to create backup procedures which isolate all of an individual's personal data to separate backup archives, and we must have the ability to fully recover the Site in the event of a natural disaster or security breach and protect other data stored within the same backup archive.

All personally identifiable information (such as email addresses and passwords) are strongly encrypted or hashed within our database, including the database backups.

These backup archives will generally not be retained for a period of time longer than 90 days, and are transferred off the production server, and to off-site encrypted storage as soon as possible.

In the rare event that you have requested to remove your account and we must later restore from a backup archive to our production server which still retains a copy of your personal data, we will honor your initial request and immediately reprocess your request for erasure to delete and anonymize your information on our primary production database.

8. Right to Control and Access Your Information

8.1 Right of Access

You have the right to access your Personal Data that we hold about you. i.e. the right to acquire (i) information on whether your Personal Data is retained, (ii) access to such information and/or (iii) duplicates of the Personal Data retained. To exercise this right, contact us as set forth in Section 10 from the email that is registered to your account, or login to your ScoreHero account and click here to access a summary outlining all information that you've provided to the Site, showing your Account Information displayed along with links to your scores, forum posts, wiki pages, and/or custom songs.

8.2 Right to Rectification

If we process your Personal Data, we shall endeavor to ensure by implementing suitable measures that your Personal Data is accurate and up-to-date for the purposes for which it was collected. If your Personal Data is inaccurate or incomplete, you can change the information you provided. This page provides a link to edit/update your Account Information. All other links to your scores, forum posts, wiki pages, and custom songs will lead to pages which contain Edit functionality to modify and/or replace any piece of your information with corrected data. If you have any questions regarding how to exercise this right for any of your information, contact us as mentioned in Section 10 below.

8.3 Right to Erasure

You have the right to delete your ScoreHero account, following the procedure set forth on this page. Personal Data associated with your account will be deleted or anonymized subject to Sections 6 and 7 above, and with the categories of information handled as outlined below:

  1. Account Information. Your username will be changed to "anonymous" and all other associated Basic Account Information (including your encrypted email address and hashed password) and Additional Profile Information will be deleted from your main account, your forums account, and your wiki account, including any personalized settings and/or benefits that you have received. If you have donated to ScoreHero, the record of your donation amount(s) and PayPal Transaction ID(s) will be retained for tax purposes as subject to law per Section 6.
  2. Scores. You have the ability to delete any or all of your submitted scores prior to initiating a full account deletion. Any scores which remain in your account upon time of deletion will be anonymized, which includes removal of all provided comments and external photo and video URL links, and changing the displayed username associated to such scores to "anonymous." If you object to this type of processing, contact us and we may be able to remove the anonymous scores upon processing your request.
  3. Forums. With exception of any threads transferred to another user as mentioned in Seciton 2.2.2, all forum posts that you have submitted will appear to be posted by "anonymous" with a body that states "This post was deleted."
  4. Wiki. With exception of any wiki pages transferred to another user as mentioned in Seciton 2.2.3, all wiki pages that you have posted will be removed from the Site, and any edits that you have made on other public wiki pages will appear in the Page History to be edited by "anonymous." Comments posted to wiki pages will be changed to "This comment was deleted." and will appear to be sent by "anonymous."
  5. Custom Songs. All information related to custom songs that you have posted to the Site will be removed, including the download history for your songs. Your download history for other custom songs will also be removed.
  6. Private Messages. The body of text for private messages remaining on the server will be changed to "This message was deleted." with the sender's username changed to "anonymous."
  7. User Reports. These will be retained by ScoreHero for our recordkeeping purposes, but will appear to be sent from "anonymous" to us.
  8. Miscellaneous Information. Any other references to your username, or personal information, gathered from various utilities and/or temporary promotion or contest submissions provided on ScoreHero will be removed or anonymized consistent with our approaches mentioned for other sections of the Site.

8.4 Right to Object

When our processing of your Personal Data is based on legitimate interests according to Article 6(1)(f) of the GDPR, you have the right to object to thise processing. If you object we will no longer process your Personal Data unless there are compelling and prevailing legitimate grounds for the processing as described in Article 21 of the GDPR; in particular if the data is necessary for the establishment, exercise or defense of legal claims.

You also have the right to complain to a data protection authority about our collection and use of your personal information. For more information, please contact your local data protection authority.

9. Updates to this Privacy Policy

We may update this Privacy Notice from time to time in response to changing legal, technical or business developments. When we update our Privacy Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make.

You may exercise your right to access personal information, or request personal information to be erased. Please note that other third parties (our data partners) may be data controllers of your information. You can find details of the third parties that we work with in Sections 2.4 and 4.4.

We will respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.
